In a win for the state prosecutor’s office, a judge this morning denied a motion by lawyers for Baltimore Mayor Sheila Dixon to dismiss the two perjury charges against her.
In a 10-page memorandum accompanying his order, Circuit Judge Dennis M. Sweeney wrote that he was “not satisfied” with the defense arguments that the state prosecutors had trampled on Dixon’s legislative immunity.
State prosecutor Robert A. Rohrbaugh said he is “pleased” with the decision and said the case is now “ready for trial.”
Dixon defense lawyer Dale P. Kelberman said that the mayor’s defense is weighing whether or not to appeal the finding. “We think we have a good argument,” Kelberman said. Her attorneys have 30 days to file an appeal.
